Terms of service

These Terms and Conditions (“Terms”) apply to all services provided by Mylka (“we”, “us”, “our”) to customers (“you”, “your”). By purchasing, booking, or using our services, you agree to be bound by these Terms.


1. Our Service

Mylka provides a professional breastmilk processing service, including the freeze-drying of customer-supplied expressed breastmilk. Our service is intended to assist with storage convenience and flexibility and does not replace medical, nutritional, or healthcare advice.


2. Customer Responsibilities

You are responsible for ensuring that:

  • All milk provided is your own expressed breastmilk

  • Milk is stored, labelled, packaged, and frozen in accordance with our instructions

  • Milk is stored in approved breastmilk storage bags only

  • Milk has been fully frozen for a minimum of 48 hours prior to shipment

  • All information provided to us is accurate and complete

Milk that is incorrectly packaged, inadequately frozen, or does not meet our requirements may be returned unprocessed at your expense.


3. Shipping & Transit Risk

3.1 Transit Liability

You acknowledge and agree that all breastmilk is shipped at your own risk.

Mylka is not responsible for any loss, damage, thawing, contamination, spoilage, or degradation of breastmilk that occurs during transit to or from our premises, including but not limited to delays, handling errors, temperature changes, or courier disruptions.

3.2 Acceptance of Risk

By sending milk to Mylka, you accept full responsibility and liability for your milk during transit and acknowledge that breastmilk is a perishable and sensitive product.


4. Limitation of Liability

To the fullest extent permitted by New Zealand law:

  • Mylka excludes all liability for any loss, damage, or deterioration of breastmilk arising from handling, storage, shipping, courier delays, power outages, equipment failure, or events beyond our reasonable control.

  • Mylka is not liable for any indirect, consequential, or incidental loss, including emotional distress or loss of supply.

  • Our total liability, if any, is limited to the amount paid by you for the specific service giving rise to the claim.

Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993, except where you are acquiring services for business purposes, in which case the Act does not apply.


5. No Medical Advice

Mylka does not provide medical, nutritional, or health advice. You are responsible for determining whether freeze-dried breastmilk is suitable for your circumstances and for consulting with appropriate healthcare professionals if required.


6. Processing Outcomes

While freeze-drying is a gentle preservation method, outcomes may vary depending on milk quality, handling, storage, and transit conditions. Mylka does not guarantee identical results to fresh or frozen milk.


7. Payment & Fees

All fees must be paid in full prior to processing unless otherwise agreed in writing. Prices are listed in New Zealand Dollars (NZD) and may be subject to change.


8. Cancellations & Refunds

Once milk has been received and processing has commenced, refunds are not available. If a service cannot proceed due to non-compliance with these Terms, milk may be returned unprocessed at your cost.


9. Privacy

We collect and use personal information in accordance with the Privacy Act 2020. Personal information is used solely for the purpose of providing our services and will not be shared except where required by law.


10. Governing Law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.


11. Amendments

Mylka reserves the right to update or amend these Terms at any time. The version published on our website at the time of your booking will apply.
